Your personal data – what is it?
Personal data relates to a living person who can be identified from that data. Identification can be by the information alone or in conjunction with any other information in the data controller’s possession or likely to come into such possession. The processing of personal data is governed by the General Data Protection Regulation 2016/679 (the “GDPR”)
How I use your information
I process personal data relating to those I provide psychotherapy services to (inclusive of supervision to psychotherapists and trainee psychotherapists). This is so that I am able to provide the services to you that you have requested of me.
This personal data includes identifiers such as names, addresses, gender, sexual orientation, personal and family history, medical history (inclusive of any psychiatric diagnosis and or treatment), ethnicity and other personal information where this information has been shared with me including IP addresses.
Collecting and using your information in this way is lawful because:
the processing is necessary for the performance of my services to you;
the processing is necessary for the performance of a legal and professional obligations to which I am subject.
the processing is necessary if it were to protect the life of you or someone else
How I share your information with third parties
I will not share information about you with third parties without your consent unless the law allows me to.
I may be required, by law, to pass on some of the personal data which I collect to under statutes (or other legislative provisions) enacted from time to time, if I have a court order made requiring me to disclose personal data, for professional obligations to enable me to perform my services to you (such as obtaining supervision from practitioners who are subject to the same privacy rules as I am) in accordance with my professional obligations or if it is necessary to protect your or someone elses life.
How long I keep your personal information and how do I store it:
I only keep your information for as long as I need it or for as long as I am required by law to keep it. I keep details of your name, address, date of birth, contact telephone numbers, contact email addresses and GP details on my computer which is password protected in files that are also password protected and also on my mobile telephone which is both password and finger print protected. I also sometimes keep brief notes of sessions as an aide memoire (which are anonymised) in handwritten note form in a locked cabinet in my home/office. I maintain an appointments diary in handwritten form with the names of clients anonymised I usually carry that diary with me to appointments. If we have corresponded by email I will keep copies of the emails on my email account but delete any with attached files that you have sent me and I save those emails with the attached files password protected on my computer. I can access information held on my computer via cloud services, such access is password protected and restricted to me alone.
Your rights
You have the right to:
ask for access to your personal information;
ask for rectification of the information I hold about you;
ask for the erasure of information about you;
ask for my processing of your personal information to be restricted;
ask to receive your data in a form allowing you to transit it to another data controller (portability);
or object to my processing your information.
